PayNow Copyright Policy

Overview

PayNow Services, Inc. ("PayNow," "we," or "us") respects the intellectual property rights of others and expects all users of our platform — including Creators, Buyers, and visitors — to do the same. Our User Agreements require that content posted or uploaded through our Services be accurate, lawful, and non-infringing of any third party's rights.

This Copyright Policy describes how PayNow handles claims of copyright infringement on its platform, including our website (paynow.gg), Creator Stores, and Marketplace Platforms. It applies to all content submitted, uploaded, or otherwise made available through our Services.

PayNow has implemented procedures under the Digital Millennium Copyright Act (17 U.S.C. § 512) for receiving written notification of claimed copyright infringements, and has designated an agent to receive such notices.

If you believe in good faith that your copyright has been infringed by content on our platform, please submit a written Notice of Copyright Infringement that includes all of the following:

  • An electronic or physical signature of the person authorized to act on behalf of the copyright owner;
  • A description of the copyrighted work you claim has been infringed;
  • A description of the specific content on our platform that you claim is infringing, including its URL or sufficient detail to locate it;
  • Your email address, mailing address, and/or telephone number;
  • A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf.

Counter-Notice Procedure

If you believe a copyright infringement notice was incorrectly submitted against content you posted, you may submit a Counter-Notice pursuant to Sections 512(g)(2) and (3) of the DMCA. Your counter-notice must include:

  • Your physical or electronic signature;
  • Identification of the material that was removed and where it appeared before removal;
  • A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification;
  • Your full name, email address, and mailing address; and
  • A statement that you consent to the jurisdiction of the Federal District Court for your address's judicial district (if in the United States), or the Northern District of California (if outside the United States), and that you will accept service of process from the complainant or their authorized agent.

Please note: any notice or counter-notice must be truthful and submitted under penalty of perjury. A false notice or counter-notice may give rise to personal liability. You may want to seek legal counsel before submitting.

Content on Creator Stores and Marketplace Platforms

Creators who list Items through PayNow's Services are responsible for ensuring that all content in their Creator Store or Marketplace Platform — including product descriptions, images, and any other materials — does not infringe the intellectual property rights of any third party, as required by the PayNow Creator Agreement.

Creators must not:

  • Upload or use images, text, or other content they do not own or have a license to use;
  • List Items obtained in violation of the intellectual property rights of a third-party game or software platform;
  • Copy or reproduce descriptions, images, or other materials from other listings without authorization;
  • Remove, alter, or obscure any copyright or trademark notices from the Website, Creator Store, or Marketplace Platform; or
  • Use PayNow-provided templates, layouts, or images outside the scope permitted in the Creator Agreement.

PayNow does not review listings in advance to confirm they are non-infringing, but reserves the right to remove or disable access to any content alleged to infringe a third party's rights, at our sole discretion.

Repeat Infringer Policy

It is PayNow's policy to terminate, in appropriate circumstances and at our sole discretion, the accounts of users who are found to be repeat infringers of copyright or other intellectual property rights.

PayNow's Intellectual Property

The PayNow platform, website, and all associated content, features, and functionality — including software, text, graphics, logos, and design — are owned by PayNow Services, Inc. or its licensors and are protected by United States and international intellectual property laws. No content from the PayNow platform may be reproduced, distributed, or used for commercial purposes without our prior written consent.

The PayNow name, logo, and related marks are trademarks of PayNow Services, Inc. Any use of these marks without our prior written permission is prohibited.

Other Intellectual Property Concerns

For issues other than copyright infringement — such as trademark violations, false listings, or other content concerns — please contact us at support@paynow.gg. We will investigate and take appropriate action at our discretion.

Changes to This Policy

We may update this Copyright Policy from time to time. Changes are effective immediately upon posting. Your continued use of the Services following any update constitutes your acceptance of the revised policy.
